ACC Denies Resulting Mold Damages - Illinois Appellate Court upholds lower court denial of mold coverage in homeowners insurance policy. The court ruled the mold exclusion with its anti-concurrent causation clause is clear and unambiguous. click here (pdf format)
ACC Denies Property Insurance Coverage - Insurer denies coverage to City of Salida Colorado for roof collapse. Citing the anti-concurrent causation clause, the appellate court determined the insurer did not have to pay any of the $1 million in damages. The appellate court reversed the trial court decision allowing for apportionment of the loss. click here (pdf format)
Billion Dollar Property Loss Uninsured - Ninth Circuit Courts of Appeals rules flood exclusion with its anti-concurrent causation clause denies coverage for Northup-Gruman Katrina claims. Damages exceeded $1 billion but the property insurer Factory Mutual has only paid $15 million. Case is still in litigation in California. click here (pdf format)
ACC Upheld - School Buildings Uninsured - Louisiana federal district court reversed itself on the anti-concurrent causation clause. Citing the Fifth Circuit Courts subsequent decisions finding the clause unambiguous, the court denied property insurance coverage for damages to school buildings caused by Hurricane Rita.
